Mississauga Domestic Assault Lawyers Defending Clients Against Criminal Charges
Arguments between spouses, partners, or family members can result in the police being called by one of the parties in the dispute, or someone who overhears or witnesses the argument (such as a neighbour or bystander). Once the police arrive, it is within their complete discretion to lay domestic violence charges, whether or not any of the participants want to pursue such charges.
When you are facing domestic assault charges, immediate conditions will more than likely be imposed on you that limit contact with your partner and children. If you are convicted, your whole life will change. If you have been accused of domestic assault, it is critical to consult with a knowledgeable criminal lawyer who has specific experience defending these complex matters as soon as possible. A lawyer can help you maintain contact with those that you love while the matter plays out in court.
Like sexual assault cases, domestic assault cases are challenging: often involving only two individuals and often no witnesses. Bringing an effective defence in such circumstances can be difficult and must be undertaken carefully. At Campbell Bader LLP we have been representing clients charged with domestic assault since 1999. Over the years we have seen it all and have successfully defended individuals in even the most thorny situations.
What is Domestic Assault?
In general, simple assault involves a physical interaction between individuals and can include situations where one person has intentionally hit, pushed, or otherwise touched another person. Such assault involves no weapons and minimal or no injury.
Assault causing bodily harm involves the same kinds of physical interactions, but the interactions result in the victim sustaining longer lasting or more serious injury.
Assault with a weapon again involves the same type of physical interaction, but with a weapon. The weapon does not have to be the standard object most people associate with that word (i.e. knife, gun) but can include otherwise innocuous objects (e.g. a set of keys, a phone, or another household object).
Domestic assault is a more specific form of simple assault and differs in that it occurs within the context of an intimate relationship (which can include spouses, same-sex partners, unmarried couples, family members, etc.). Due to the specific dynamics that are often involved in domestic assault cases, prosecutors will generally treat such allegations more seriously than simple assault matters.
Consequences of Domestic Violence Charges and Conviction
Being accused of domestic assault or charged with the offence has very serious consequences that will impact your entire life.
In addition to not being able to have contact with your spouse, partner and/or other family members, including children, if you are convicted of domestic violence you will have a permanent criminal record, and your conviction will be public/readily accessible. This will impact your reputation in the community, any future relationships, potential job opportunities, and your ability to travel outside of Canada. You may also face jail time, probation, fines, restitution, and counselling.
